Trademark – Its Importance In Commerce
Trademarks are government approved intellectual property rights given to brands and logos. It is generally a word or a group of words or even a logo that helps consumers differentiate products of a brand or company from others. However, it can also be given for shapes, patterns, sounds or even smells.
Trademarks undoubtedly play a very important role in ensuring smooth flow of commerce. With increasing global trade, their significance has only grown further as a large number of corporate houses now compete against each other in global markets.
original products are a result of strenuous efforts and investment from the manufacturer, who would not want other companies to make profits out of their labour. However, it is tough to keep an eye on every single act of piracy and thus, there is need for the law to step in and give you adequate protection against acts of duplication of your company’s products by competitors.
Brands are an important tool in a market place as they act as a reminder of the firm and its offerings to the consumers. This helps them in differentiating a particular manufacturer’s products from the rest and making a knowledgeable decision on the basis of the merits of that particular brand. A trademark is a means of ensuring that a manufacturer has the sole right to market products under a particular brand name. This secures the interests of the manufacturer as the consumers would not confuse the items of the manufacturer with other brands.
A trademark also bestows the manufacturer with the legal authority for suing any infringer of that particular trademark as it validates the rights of ownership of the manufacturer over the concerned intellectual property. This is very important for the appropriate working of a good system of commerce, where a company is allowed to reap the harvest of its strenuous efforts as well as of the brand image that it has built among the consumers.
